User Generated Content Contest (the “Contest”)

1.     ORGANISING COMPANY

ACCOR, a public limited company with the capital of EUR 784 148 184, registered in the Nanterre Trade and Companies Register under number 602 036 444 and its registered office at 82 Rue Henri Farman, 92130 Issy-les-Moulineaux (hereinafter the "Organising Company"), is organising a free competition with no purchase obligation (hereinafter the "Contest") on Mövenpick Hotels & Resorts global Instagram page @movenpickhotels from October 1st, 2022 at 10 am (UTC+1) to December 30, 2022 at 23:59pm (UTC+1). The Contest is entitled: “#HotelsToIndulge”.

This Contest will be accessible at the following URL: https://www.instagram.com/movenpickhotels/ on the Instagram mobile application, on computer and on tablet.

 

2.     SCOPE OF CONTEST

This Contest is being held exclusively at the Organising Company's Global brand Instagram page “@movenpickhotels” from October 1st, 2022 at 10 am (UTC+1) to December 30, 2022 at 23:59pm (UTC+1) and will be available in English.

The dates and times indicated in these rules refer to UTC+1 time zone (Brussels, Copenhagen, Madrid, Paris). No other time zone will be taken into account for participation in the Contest.

Participation is open to legal residents of their country/territory of residence and who are at lease the age of majority (of 18 years of age if there is no statutory age of majority) in such country/territory as of the date of their submission to the contest, have access to internet, a valid email address and a public Instagram account (here in after the “Participant”), with the exception:

 

a.        of the Organising Company’s partners and subcontractors;

b.        of the family members of the persons listed in i, ii and iii;

c.         in general, of any company or natural person directly or indirectly involved in the Contest’s arrangement or organisation;

d.        residents of Brazil or any other existing country forbidding the competitions on social media or prize draw cannot participate in this Contest.

 

3.     KNOWLEDGE AND ACCEPTANCE OF THE RULES

These rules govern the implementation of the Contest and the selection of the winners.

Each Participant acknowledges having read the rules in their entirety and the principles of the Contest and accepts the conditions therein. Participation in this Contest shall be deemed to imply full and complete acceptance by the Participant of all the terms and conditions specified in these rules, the applicable online code of conduct, and the applicable laws and regulations regarding contests.

Failure to comply with any of the provisions of these rules will invalidate participation.

This Contest is accessible from Instagram, and each Participant must therefore also comply with the terms of use of Instagram. The Participant also acknowledges the privacy policy of the social network Instagram.

However, this Contest is not managed, certified or sponsored by Instagram. The information that the Participants submit is provided to the Organising Company but not to Instagram and will not be sold or given to any third parties in any way whatsoever.

 

4.     HOW TO PARTICIPATE

No purchase or booking necessary. To enter the Contest, during the Contest Period, take a photograph or video of your unexpected moment of joy (“content”) and upload it via Instagram.

To upload the content via Instagram, the Participant must complete the following steps:

1.     Create or log onto your Instagram account

2.     Please make sure that the “Private Account” option in your account privacy settings is set to be “OFF” before posting the photograph (your Instagram profile needs to be public)

3.     Post a photo or a video reel of your unexpected moment of joy

4.     Include a short caption to describe your moment

5.     Hashtag #HotelsToIndulge

6.     Tag @Mövenpickhotels

 

Images and videos do not need to be in a Mövenpick hotel, resort or destination where our hotels are situated. The Company may contact participants to verify their Instagram hashtag Submission was a Submission and to verify permission to repost the Submission on the Contest Website. If permission to repost is not granted or the Submission is not verified, it may be disqualified.

A maximum of ten (10) submissions per person and per email address/account per Monthly Entry Period will be considered for entry into the Contest. However, each participant shall only be eligible for a maximum of 1 Monthly Prize per Monthly Entry Period. A participant may only use one (1) Instagram account to participate in the Contest, and such account may only be used by one (1) person regardless of whether the account is shared by two (2) or more people. Any person who is found to have entered the Contest with more than one (1) account may be disqualified and all such Submissions received by such person during the Contest Period may be disqualified, and the prize won may be forfeited in the Company’s sole discretion. All incomplete or non-conforming Submissions and their entrants may be disqualified.

Each Submission shall conform to the following content restrictions (“Content Restrictions”), failing which shall result in immediate disqualification and removal from the Contest in the Company’s sole and absolute discretion:

a.        The Submission must not contain material that promotes illegal drugs or firearms (or the use of any of the foregoing), or any activities that may appear unsafe or dangerous, or any particular political agenda or message;

b.        The Submission must not depict the Accor Group or Movenpick Hotels & Resorts in any way that would constitute trade disparagement or defamation, contain any negative statements about the Accor Group or its services or amenities, or defame or contain negative statements about any of the Accor Group’s guests and/or visitors;

c.         The Submission must be consistent with the image and values of the Company and be consistent with and satisfy the purpose of the Contest;

d.        The Submission must not have been submitted previously in a promotion or contest of any kind or exhibited or displayed publicly through any means prior to the Contest;

e.        The Submission must not contain commercial content or promotions for any products or services other than products and services of Company; and

f.         The Submission must not contain any identifiable third party products, trademarks, brands and/or logos, other than those of Company (e.g. any buildings, products appearing in your Submission must not contain any visible logos, trademarks or other third party materials unless the appropriate consents have been obtained --- NOTE: all identifiable third party products, trademarks, brands and/or logos for which consent has not been obtained by the entrant must be blurred out so as to be unrecognisable).

 

5.     WARRANTIES AND REPRESENTATIONS

By entering the Contest, you warrant and represent the following:

a.        the Submission is your original work;

b.        you are the sole and exclusive author and owner of the Submission;

c.         you are the sole owner, controller and operator of the Instagram Account which made the Submission;

d.        the Submission does not and will not violate or infringe any rights (including without limitation intellectual property rights) of any third parties;

e.        any third parties appearing in the Submission have given you appropriate consent to be photographed and used in accordance with these Terms and Conditions;

f.         all information you have provided in respect of the Contest is true and accurate; and

g.        it shall be lawful for you to enter into the Contest and make the Submission.

 

6.     DETERMINATION OF THE WINNERS

The following process will be used to determine the winning Submission.

a.        During each Monthly Entry Period, Submissions will be judged by a panel of judges selected by the Company, which may include members of the Company’s marketing team and its advertising and promotional partners (“the Brand Council”). The Brand Council consists of a panel of judges, who will assess the Submissions according to the criteria outlined below. Scores will then be compiled for a collected average score. For the Grand Prize judging, the Brand Council will judge the 18 Monthly Prize Winners per the method above.

b.        All Submissions will be judged at the sole and absolute discretion of the Brand Council according to the following criteria in equal measure: (i) quality, meaning the brightness and evenness of illumination, contrast, resolution, geometry and colour; (ii) creativity, meaning the artistic interpretation; and (iii) authenticity, meaning unlike anything else and originality. Each Submission will be given a score for each criteria as well as a total overall score.

c.         By submitting a Submission, entrants agree to abide by this process of winner selection and the Brand Council’s decision, which is final and binding in all matters related to the Contest, and the awarding of a prize.

7.     PRIZES

I. Monthly Prize Winners

For each Monthly Entry Period, there shall be two (2) winners of the Monthly Prizes (each a “Monthly Prize Winner”).

Each “Monthly Prize” consists of 20,000 ALL Points (Accor Live Limitless Loyalty Programme Points). The points may be used to redeem awards such as complimentary nights, dining rewards at participating hotels of Accor Group. The two Submissions during each Monthly Entry Period judged by the Brand Council with the highest overall score shall be eligible for a Monthly Prize. In the event of a tie, the Submissions involved in the tie will be re-judged by an additional judge of the Senior Management of the Company who will serve as a tiebreaker and who will evaluate tied Submissions according to the criteria listed above.

II. Grand Prize Winner

At the end of the Contest Period, there shall be one (1) selected entrant to be the potential winner of the Grand Prize. The Submission judged by the Brand Council with the highest overall score among the Monthly Prize Winners during the entire Contest Period shall be eligible to receive the Grand Prize (the “Grand Prize Winner”). In the event of a tie, the Submissions involved in the tie will be re-judged by an additional judge of the Senior Management of the Company who will serve as a tiebreaker and who will evaluate tied Submissions according to the criteria listed above.

The Grand Prize shall consist of the below. The approximate retail value of the Grand Prize is up to US$10,000; however the actual retail value will depend on travel origin, dates of travel and hotel accommodation. Grand Prize Winner may bring one (1) guest. All trip details, including flight bookings, hotel reservations and ground transportation shall be made by Company or Company’s agent, and shall be at sole and absolute discretion of Company. The selected entrant must advise Company no later than ninety (90) days prior to the intended date of travel of the name, address, and other details for both him/herself and his/her guest. In the event that the prize winner does not provide this information to Company by this deadline, the prize will be forfeited and not awarded and Company will have no further obligation to the prize winner:

a.        Two (2) economy class return flights, booked by the Company (air carrier, departure city and arrival city are at the sole and absolute discretion of Company), departing from the international airport closest to the winner’s residence as designated by Company arriving at the international airport closest to the city where the Hotel of Choice (as hereinafter defined) is located; If winner resides within a 100-mile radius of trip destination, Company reserves the right to provide ground transportation in lieu of air transportation and no compensation or substitution will be provided for difference in prize value;

b.        A consecutive 5-night stay inclusive of breakfast at the designated breakfast restaurant at the Hotel of Choice (as defined below) for two (2) persons in a standard double room (or such other class to be determined by the Company or the Hotel of Choice at the time of booking or on arrival);

c.         A choice of two (2) meals during the 5-night stay (lunch or dinner up to the value of US$150 per person, per meal) at designated restaurants at the Hotel of Choice;

d.        Airport pick-up and drop-off between the airport closest to the Hotel of Choice and the Hotel of Choice for two (2) persons.

e.        For the Grand Prize, the Grand Prize Winner shall be entitled to choose a hotel of choice at one of the following Mövenpick Hotels and Resorts (the “Hotel of Choice”):

1.        Winner’s choice of one of eight Mövenpick hotels in Dubai, UAE

2.        Mövenpick Resort Al Marjan Island, UAE

3.        Mövenpick Resort & Spa Dead Sea, Jordan

4.        Mövenpick Hotel Mansour Eddahbi Marrakech, Morocco

5.        Mövenpick Hotel Istanbul Bosphorus, Turkey

6.        Mövenpick Hotel Amsterdam City Centre, Netherlands

7.        Mövenpick Hotel Berlin, Germany

8.        Mövenpick Hotel Basel, Switzerland

9.        Mövenpick Myth Hotel Patong Phuket, Thailand

10.      Mövenpick Resort Cam Ranh, Vietnam

 

The prize must be completed before December 30, 2023 and must be booked at least ninety (90) days prior to intended travel dates.

Ground transportation, transfers from the Grand Prize Winner’s home to the airport, baggage costs, in-flight purchases, internet charges, meals not described above, personal expenses such as mini-bar, room service, photographs, internet access, telephone charges, laundry services, souvenirs, incidentals, taxes and gratuities are not included. NOTE: Grand Prize Winner and/or his/her guest may be required to present a valid major credit card at the time of hotel check-in to cover any incidental expenses.

Travel Guest Eligibility. The travel guest of the prize winner (the “guest”) must: (i) be a legal resident of his or her territory of residence and (ii) have reached the age of majority in their province/territory of residence at the time of the Grand Prize Winner’s Submission to the Contest unless the Grand Prize Winner is the guest’s parent or guardian. Each Guest (or the Grand Prize Winner as parent/guardian if applicable) must sign and return the Travel Guest Release of Liability and Publicity Release Form (the "Guest Prize Form”) by the date indicated on the Guest Prize Form indicating, among other things, that he/she waives all recourse against the Releasees (as defined below) relating to his/her participation (or his/her child’s participation if applicable) in the Prize and/or related activities (including, without limitation, any travel related thereto).

The Grand Prize Winner and his/her guest must provide proper legal identification to leave and re-enter their country of residence, and must be in possession of valid passports (valid for six (6) months past the return date). The Grand Prize Winner and his/her guest accept full responsibility for obtaining these documents at their sole expense. It is recommended that the Grand Prize Winner and guest obtain sufficient personal insurance including medical insurance, prior to departure. The Grand Prize Winner and his/her guest must be able to legally enter the applicable foreign country and must travel together and on the same itinerary. Company is not liable if the Grand Prize Winner and/or his/her guest are refused access to a plane, entry into any country, or re-entry into his/her home country. If travel is delayed, impeded, cancelled or refused by any authority or for any reason, Prize may be forfeited (in whole or in part) and Grand Prize Winner and/or his/her guest will be responsible for any additional expenses incurred. Once airline tickets are purchased and/or issued: (i) all tickets are non-transferable, non-refundable and not redeemable for cash; and (ii) the guest, travel dates, origin and destination cannot be changed. Lost tickets will not be replaced. The Grand Prize may be forfeited if travel does not take place once tickets are purchased and/or issued. Certain travel restrictions may apply. Air transportation and hotel accommodations are subject to availability. Winner and guest must travel together on the same itinerary and are responsible for obtaining all required travel documents prior to travel. Flight schedules are subject to change without notice.

Releasees (as defined below) are not liable for any expenses incurred as a consequence of flight cancellation/delay. Tickets are subject to certain terms and conditions specified thereon.

All prizes are non-negotiable, non-transferrable and cannot be exchanged into cash and other forms of credit unless otherwise provided. Each prize is subject to its own set of terms and conditions. In particular, redemption of the Grand Prize shall be subject to a fixed redemption period, availability and blackout dates depending on the destination and time of booking, and documentary proof of their city of residence to the Company’s satisfaction. Prizes are provided "as is" without further representation, warranty or guarantee of any kind, express or implied. In no event shall Company be obligated to award any of the prizes should it determine, in its sole and absolute discretion, that the Submissions are unsatisfactory. In the event any element of any prize becomes unavailable for any reason beyond the reasonable control of Company, Company shall provide a substitute prize selected in its sole discretion. Winners are solely responsible for all federal, state, and local taxes and other fees associated with prize receipt and use. No other substitution, assignment or transfer of prizes permitted, except by Company in its sole discretion.

Only one prize will be awarded per household (same last name/same address and/or same email).

Under no circumstances may financial consideration be requested as a substitution for the offered prize. The Organising Company reserves the right, if circumstances so require, to replace this prize with another prize of equivalent value.

The Organising Company cannot be held liable for the use of the prize by the winners. Any resale of the prize by the winners is strictly prohibited. The Organising Company disclaims any liability for possible disputes relating to the terms and conditions pertaining to the awarding of the prize.

 

 

8.     NOTIFICATION OF THE WINNERS

Winners will be announced on the Company’s Instagram @movenpickhotels as follows:

a.        Monthly winners will be announced on:

               i.         October 29, 2022  - Cut-off date for October’s submissions will be October 24, 2022

              ii.         November 28 - Cut-off date for October’s submissions will be November 24, 2022

             iii.         January 4, 2023 - Cut-off date for December’s submissions will be December 24, 2022

b.        Grand Prize winner will be selected and announced on January 12, 2023 from amongst the Monthly Prize winners.

               i.         The Company may contact entrants to verify their Submission and permission to re-post the Submission on but not limited to the Contest Website, the Company’s own social media channels. If permission to re-post is not granted or the Submission is not verified, it may be disqualified.

              ii.         The Company will contact the winners via direct message on Instagram for prize notification. If any winner (who made their Submissions via Instagram) fails to provide their contact details for prize distribution within 15 business days of first notification attempt, if any winner rejects his/her prize or in the event of non-compliance with these Terms and Conditions, such prize shall be forfeited and may be awarded to such other winner as shall be determined by the Company in its sole and absolute discretion. Upon prize forfeiture, no compensation shall be given and the Company shall not be liable whatsoever.

             iii.         An entrant is not deemed a winner of any prize, even if the winning notification should so indicate, unless and until the entrant's eligibility has been verified, all required documents returned and executed, and the entrant has been notified that the acceptance and verification process is complete.

             iv.         The Organising Company will ask the winners the necessary personal information to organize the prize giving: first name, last name, birth date, country of residence, ALL member ID.

 

9.     INTELLECTUAL PROPERTY

Participation in the Contest does not confer any right to the Participants regarding the intellectual property elements of the Organising Company. Also, in accordance with the provisions of the French Code of Intellectual Property, the reproduction, representation or use of all or part of the elements (graphic, textual, etc.) comprising this Contest as well as the webpage https://www.instagram.com/movenpickhotels are strictly prohibited. All trademarks, graphics, and product names mentioned are registered trademarks, graphics or product names.

Any use of the elements of the Contest, whatever the mode, is subjected to compliance with intellectual property regulations.

 

10.   MODIFICATION AND CANCELLATION OF THE OPERATION

The Organising Company reserves the right at any time, if the circumstances so require, to interrupt, delete, postpone or defer the contest and/or modify the procedures after informing Participants by any appropriate means without incurring any liability thereby.

 

11.   VERIFICATION OF ENTRY VALIDITY

The Organising Company reserves the right to perform all useful checks to ensure that each participation complies with all of the provisions set forth in these rules. To this end, the Organising Company may, in particular, verify:

   the identity of the Participant;

   the Participant is entering from one account only;

   the country of residence of the Participant.

 

12.   REQUEST FOR REIMBURSEMENT

The Organising Company agrees to reimburse upon request the costs incurred to participate in the Contest to any Participant who makes such a request, namely the internet connection fees related to participation in the Contest and the postal charges related to the reimbursement request or transmission of payment.

However, the Organising Company commits only to reimburse the Participants who have complied with the conditions of participation in the Contest and the conditions set forth in this article.

For the purpose of simplification, the Organising Company accepts only one overall request for reimbursement per household (same last name, same first name, same e-mail and postal addresses) and for the duration of the Contest.

a.        Internet connection fees related to participation in the Contest

Upon request, each Participant can obtain reimbursement of the connection fees that such Participant has incurred to participate in the Contest.

It is specifically noted that Participants who did not bear any additional connection or communication cost because of their participation in the Contest (holders of a fixed subscription rate, cable users, etc.) will not be able to obtain reimbursement.

b.        Postal costs related to the reimbursement request or transmission of payment

The Organising Company undertakes upon request to reimburse the cost of the stamp used by the Participant to make the reimbursement request and/or obtain the rules of the Contest on the basis of the applicable slow rate at the time.

c.         Procedures for reimbursement

Each reimbursement request must be sent in writing to the following address: ACCOR – 82 Rue Henri Farman – 92345 Issy.

The Participants must clearly indicate their first name, last name, full address (street and street number, postal code, city and country) in their letter and provide the following documents:

   a bank account number in the name of the Participant;

   a photocopy of the Participant's identity card;

   when applicable, copy/copies of the detailed telephone bill(s) stating the date(s) and time(s) of participation.

Any incomplete or illegible request sent to an address other than the aforementioned address or received after a period of one month after the end of the Contest, as determined by the postmark, will be considered void.

In the event of the extension or possible delay of the Contest, the deadline to obtain the rules of the Contest and reimbursements (stamps and internet connection fees) will be postponed accordingly.

Reimbursement will be made by bank transfer or credit to the Participant's account.

13.   EXCLUSION OF LIABILITY OF THE ORGANISING COMPANY

The Organising Company reserves the right to suspend, postpone, extend or cancel the Contest without prior notice in the event of force majeure, following notification by all appropriate means. It shall not be held liable for doing so.

The Organising Company may not be held liable for any disruptions to internet or electricity networks, incorrect use of the internet, failure of receiving equipment or any other incident affecting the smooth running of the Contest that could prevent a user from taking part before the deadline.

Participants are responsible for taking all the necessary steps to protect their own data and/or software stored on their computer equipment against any attacks. Participants are fully responsible for their own connection to the page and their participation in the Contest. Any Participant attempting to tamper with the computer system of the Contest in any way whatsoever in order to win or to attempt to win will be disqualified from the Contest. In addition, the Organising Company reserves the right to take legal action against anyone who has cheated or attempted to do so.

The Organising Company may not be held liable for any damage or injury of any kind due to:

   malfunction of the website, computer errors or viruses or other problems that may cause damage;

   following events having the characteristics of force majeure (strike, bad weather, war, attack) that partially or totally deprive the winners of their prize;

   following any incident taking place to the winners during the enjoyment of their prize.

The Organising Company cannot be held liable for the rejection of any participation that does not comply with all the provisions of these rules.

 

14.   CONDITIONS, LIMITATIONS AND LIABILITIES

a.     The Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. Instagram is completely released from all liability by each participant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Company and not Instagram.

b.     In no event shall more prizes be awarded than the number of each type stated in the “Prizes” section above.

c.      The Contest and all prizes are provided “as is” without warranty of any kind, either express or implied.

d.     By entering the Contest, you agree to release, hold harmless and indemnify the Company, its advertising and promotion agencies, the Brand Council, and any member of Accor SA, Instagram, or other party in any way involved in the development or administration of this Contest, including suppliers of materials or services related to the Contest and all of their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns (the “Releasees”) for all losses, costs, damages or claims arising as a result of or in connection with your Submissions, participation of the Contest, judging of Submissions, the awarding, accepting, arranging or use of the prizes, non-compliance with these Terms and Conditions or any applicable laws and regulations and/or violation or infringement of any third party rights.

e.     Without limiting the generality of the foregoing, the Releasees are not responsible for and expressly disclaim any and all liability associated with (i) the incorrect or inaccurate capture of Submission information, including communication failures or human error that may occur in the receipt or processing of Submissions, or for destruction of or unauthorized access to, or alteration of, Submissions and/or any submitted in a manner that is not expressly allowed under these Terms and Condition; (ii) late, lost, stolen, contain false information, damaged, misdirected, garbled or incomplete Submissions, transmissions or transactions, those that are altered or otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Terms and Conditions; (iii) any loss, damage, or claims caused by, or in any way related to an awarded Prize or the Contest itself; (iv) any problems or technical malfunctions, including failure of servers, hardware or software transmission, errors, omissions, interruptions, communication failures, including any malfunctions of Instagram or the Contest Website or any operations or transmission of information during the Contest Period, including, without limitation, any problems, human or technical, errors, lost, delayed, garbled or corrupted data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone, communication or transmission lines, technical malfunctions of any computer on-line systems, servers, access providers, computer equipment, hardware or software, failure of any e-mail or Submission to be received on account of technical problems or traffic congestion on the Internet or at any Contest Website, or any combination thereof including, without limitation, any injury or damage to an entrant’s or any other person's computer related to or resulting from participating in or downloading any material connected to the Contest, all of which may affect a person’s ability to participate in the Contest; (v) any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including, without limitation, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise; (vii) any claims regarding the judging of Submissions, or the awarding, accepting arranging or use of the Prizes; or (viii) electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind. Submission material/data that has been tampered with or altered is void.

 

f.      Releasees shall not be liable:

               i.         for exercising the Company’s rights under these Terms and Conditions or as otherwise permitted by law, if the Contest cannot take place or if any prize cannot be awarded or redeemed due to causes beyond its control or otherwise not allowed under the applicable laws and regulations;

              ii.         for technical malfunctions, errors or failure of any kind, lost Submissions, lost or unavailable network connections, Contest Website, internet or ISP availability, or failed, incomplete or delayed computer transmissions which may limit one’s ability to enter the Contest, including any damage to any computer relating to or resulting from participating in the Contest; and

             iii.         for damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages.

15.   PLACEMENT AND ACCESSIBILITY OF THE RULES

The rules may be modified at any time by the Organising Company in the form of an amendment. Amendments will be published online.

Any claim must be made by Direct Message to the Organising Company's Global brand Instagram page “@Movenpickhotels”, before January 12, 2023. After this date, no claim will be accepted.

The rules are sent free of charge to any person who so requests by mail at the address of the Contest before the close of the Contest (determined by the postmark).

16.   COMMUNICATION ABOUT THE WINNERS

The winners authorize the Organising Company to use, publish and communicate their Instagram alias and name, accompanied by their prize. Otherwise, the winners may expressly indicate their refusal regarding communication of their name in their response to the Instagram Direct Message of the Organising Company informing them of their prize.

 

17.   PERSONAL DATA

In accordance with applicable data protection regulations, information concerning you is processed by Accor SA, the Organising Company, acting as data controller. This processing is necessary for the purposes of performing this Contest, enabling your participation in the Contest to be taken into account, determining the winners and awarding prizes.

Your personal data is intended for use by the authorised personnel of the Organising Company, for the purposes of managing the Contest and service providers for the only needs of organising the Contest, selecting the winners and awarding the prize to the winners. Unless otherwise provided for by law or regulations, your personal data will be kept until the date on which the winners will receive their prizes.

To exercise your rights (access to data, rectification, deletion, limitation or opposition to processing, definition of guidelines for the processing of your data after your death), please write to brandmanagement@movenpick.com. You can also contact the Accor Data Protection Officer by writing to accorhotels.dpo@accor.com or file a complaint with a supervisory authority.

18.   APPLICABLE LAW AND LANGUAGE OF THE RULES

These rules are governed by and subject to the provisions of French law, without prejudice to any mandatory protective provisions that may apply in the Participant’s country of residence.

These rules are written in English. In the event of a contradiction with any foreign language version, the provisions of the English version will prevail.

If any of the provisions of these rules is declared invalid and/or inapplicable, the other clauses will remain in full force and effect.

 

19.   COMPETENT JURISDICTION

In the event of a dispute arising from the interpretation or enforcement of these rules, the Participant and the Organising Company will use their best endeavours to reach an amicable settlement. In the absence of an amicable settlement, the Participant may refer the dispute to the Tourism and Travel Mediator.

Any litigation will be brought before a court with territorial jurisdiction pursuant to the provisions of the Code of Civil Procedure or of the Consumer Code.
